Court rules HIV disclosure law can only be used to charge heterosexuals

“An appellate court has ruled that Florida’s HIV disclosure law can only be used to charge heterosexuals.
The court ruled that the law did not apply in the case of a woman accused of having sex with another woman who failed to disclose her HIV-positive status . . . . the judges found that because the law referenced ‘sexual intercourse’ that it could only be applied to heterosexual activity since it is only defined as ‘the penetration of the female sex organ by the male sex organ.’
[Reminds one of  “I did NOT have sex with that woman!”]
. . .  the ruling has already had an impact on a case in Treasure Island. There, a state attorney threw out a case against a gay man charged with failing to disclose his HIV-positive status to his partner of four years.”

As Jon Stewart of The Daily Show is increasingly wont to complain, reality is making life more and more difficult for people who want to satirize it.

    Hi Dr. Bauer, instead of looking at this seemingly kookie situation from the skeptical viewpoint, let’s look at it from the viewpoint of those who take AIDS as a contagious pandemic caused by HIV very seriously. From that point of view, heterosexuals are full human beings deserving of the full protection of the law, whereas gays both male and female are not fully human, not deserving of the same considerations as straights. Sadly most gays view AIDS through mainstream lenses. So from the mainstream point of view, the law is prejudiced against gays.

    Hi Dr. Bauer, yes, I knew it was intended as satire. But mainstreamers probably wouldn’t. And while explaining satire (or a metaphor) kills it, my comment elucidates to gay mainstreamers how Florida legislators are not only hostile to gays but contemptuous of them as well.

      I guess gays are off the hook. No secret the establishment doesn’t give a damn about homosexuals. Don’t they push poison on them every day to get rid of a virus that no one has seen ? This whole thing is so ridiculous. Do people also need to disclose other “STDs” , or just “HIV”? SO much nonsense it’s hard to make rational judgements here because of the facts that have to do with this issue. Contradictory that the ones who aren’t “at risk” are the ones who have to disclose their “status”. The whole topic of HIV is so ludicrous I really struggle to make any sense of it.

        You and me both.
        I am perpetually astonished that innumerable people, pundits and reporters included, hold forth on things about which they know literally nothing except the shibboleths they have picked up from other people who also don’t know anything.
        I hear people saying “carbon footprint”, “protein”, etc., etc. when they would be hard pressed to explain or define the words they’re using.
